Terms of Service

These Terms of Service ("Terms") govern your use of the WeMove mobile application and related services (the "Service"), operated by WeMove ("WeMove", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 13 years old (or the minimum age required in your country) to use the Service.
You are responsible for keeping your account credentials secure and for all activity under your account.
You agree to provide accurate information and to keep it up to date.

2. The Service

WeMove lets you take part in GPS-based fitness challenges and virtual races, track workouts, earn badges, join team challenges, and appear on leaderboards. Features may include premium content and physical race kits available for purchase.

3. Health & safety

Important: WeMove is not a medical service. Consult a qualified healthcare professional before starting any exercise programme. You participate in all activities at your own risk. Always be aware of your surroundings — do not rely on the app for navigation or safety, and follow all local laws and traffic rules while exercising.

4. Acceptable use

You agree not to:

Submit false workout, location, or progress data, or otherwise manipulate leaderboards or challenges.
Use the Service for any unlawful purpose or in violation of these Terms.
Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or other users' accounts.
Upload content that is unlawful, offensive, or infringes others' rights.

We may suspend or terminate accounts that breach these rules.

5. Purchases

Race kits may be purchased when you start a race. Kits are physical goods (such as a t-shirt and bib) shipped to the address you provide. Delivery times and availability vary.
Premium subscriptions and other digital purchases are billed through the Apple App Store and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel in your App Store account settings.
Payments are handled by third-party processors. Prices and applicable taxes are shown at the point of purchase.
Refunds for digital purchases are handled in accordance with Apple's policies. For physical kits, contact us using the details below.

6. Charity contributions

Some challenges are associated with charitable causes. Where we state that a contribution will be made, we will use reasonable efforts to direct the stated amount to the relevant cause. Contribution amounts and recipients are described within the relevant challenge.

7. Your content

You retain ownership of content you submit (such as a profile photo). You grant us a licence to host and display it as needed to operate the Service. You are responsible for ensuring you have the rights to any content you upload.

8. Intellectual property

The Service, including its design, branding, routes, badges, and software, is owned by WeMove and protected by intellectual property laws. You may not copy, modify, or distribute it without our permission.

9. Third-party services

The Service relies on third parties (including Apple, Google Firebase, and Mapbox). Your use of those services may be subject to their own terms, and we are not responsible for them.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that fitness data will be perfectly accurate.

11. Limitation of liability

To the fullest extent permitted by law, WeMove will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users.

13. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless local consumer law provides otherwise.

14. Changes

We may update these Terms from time to time. We will revise the "Last updated" date and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.
